For those of you who either have Napster or know of it, how much longer do you think it'll be around. They're being sued right now, and I'm pretty sure they'll lose. :( Too bad, it's a great program to have. :)

Yeah, its really cool, I have over 300 Mp3z downloaded from there but I think they will not last more than another year or so.. :(

The guys over here in Canada are protesting against banning it, its pretty funny... All people want Napster so do I :)

they have no right to shut it down. the Napster guys only provide the code...they don't make you trade the mp3's, if it's someone's fault it is yours, not theirs...well atleast that is what the United States law says.

Downloading MP3's is not illigal, as long as you do not share 'em. Thought I through that in

Nope zOla, downloading MP3z is not wrong UNLESS you keep them for more than 24 hours... The point of MP3z is to listen to the music or song before buying the Album just not to waste your money..

Besides, Downloading = Sharing... ;)

downloading = sharing ? what !!

ya got this one wrong mate... it downloading = getting :D

Sharing comes from downloading but does not equal downloading

Juve Fan

Well if someone places it on his site for you to download then that means he is giving it to you i.e. Sharing it with you.. :)

ya, but that don't mean downloading = sharing

in most cases downloading leads to sharing, but it don't mean it.

Forget my nick on Napster gambine, you can call me a very nasty person when it comes to Mp3s, here is what I do heheh.. I got a T3 connection (or equivalent to it) so I state that I got a 14.4 K modem ;), I change my nick ever while so that people having me on their Hot lists cant get me anymore :), I store my MP3s on more than one different folder so that anyone who gets me doesn't view all MP3s, I always just log on , download the MP3 I want and log off again and if someone manages to start download from me in this small time I just turn it off and cancel the download...

How nasty is that eh ? Hehehe :D, if everyone thinks that way no one would have gotten any MP3s... :)

By the way gambine I remember I read about a month ago in a newspaper something about Napster here it is.. The people of Napster were asked about what are they going to do and wether they will be sued or not, guess what they answered ? They said "We are not worried at all, if a company makes an AX and a person uses that AX to kill someone does the company owner go to jail or get sued ?? NO, and this is the case with us, we are providing an interface or a program which people use to share MP3s over so we are not actually giving them the MP3s but the people are gaining advantage of the program, thats why we are not worried " ..

What do you think ?? Brilliant reasoning, they will get away with it and we will all be able to download MP3s again..

Another thing is that MP3.com is getting sued now.. Who cares, I dont even visit them..

Well I dont really know.. But all I know and what they told me is its an Ethernet connection at 10Megabitspersec... So basically if you want to compare speed or know if I am a T3 or not then here is the info : I can download from another T3 guy at 250 KB/sec... Is that a T3 ?? I have no idea.

Even if Napster goes down, something else will come up and take over for it. But I hope it doesn't go down. They may not have to pay anything in a lawsuit, but they will have to shut down.

The difference between what they are doing, and the axe analogy is that they are knowingly providing a forum for people to share mp3's with each other. If someone sells an axe to someone, and KNOWS that they are going to kill someone with it, they become an accessory to the crime because they were negligent and because they didn't prevent it.

That's why I think Napster will lose. Where will they get the money to fight anyway, I haven't seen any advertisements on it, so I don't see where they make their money.

What about a company that makes pistols ?

I think there's a very fine line there. People could use a pistol for target practice, or just because they like to collect guns. But Napster's sole purpose is to copy mp3's between people. They are providing a playform for an unauthorized(therefore illegal) transfer of music. The site is only there because of that and I don't think any judge will be in favour of them.

Look at it this way, if you invite people to your house, and set up a card table, give them cards and chips, you are both encouraging them and assisting them in committing a crime. Likewise, Napster is inviting people in, providing a network of mp3's, and enabling one person to copy from another.

None of us want Napster to lose, but I think we can all agree that what they're doing is illegal, and they shouldn't be allowed to continue.

Okay, you semi-win gambine, but I have one last argument that they might use, they are inviting people to do the crime but not commiting the crime themselves hence they cant be penalized right ?? I mean if I give you a gun for no reason and you shoot someone later on when you get angry, do I go to jail ?? I dont think so, they are guilty alright but they still can squeeze out of it easily, big companies usually can do it..

BTW Do you know they are splitting Microsoft ??? Its about 90% confirmed, that would be AWESOME right ?

And yes I know gambine we all want Napster to win but we are just discussing how they can do it :D

I'm just not so sure how big Napster actually is. Like I said earlier, I haven't seen any ads on it, so I don't know where they make their money. You gots to have money to fight the courts. :(
